EPDM ROOFING MEMBRANE SYSTEM WARRANTY

Ottawa Valley Roofing for a period of 10 years from the date of completion, guarantees to the building owner, that subject to the terms, conditions and limitation stated herein, OVR will cause any repairs to be made of any leaks caused by workmanship or materials used in the roofing system on the above building. OVR’s obligations shall not exceed the owners original cost of the installed membrane for the life of this warranty.

TERMS, CONDITIONS, LIMITATIONS

1. OVR shall have no obligation under this warranty until all bills for installation, supplies and services have been paid in full.

2. The owner shall provide OVR written notice within Thirty (30) days of the discovery of any leaks in the Roofing Membrane Systems.

3. If upon inspection it is determined that the leaks in the membrane roofing system are caused by defects in the materials or workmanship or OVR, owner remedies and OVR’s liability shall be limited to OVR’s repair of the membrane system.

4. This warranty shall not be applicable if any of the following occur:

a) If the roofing system is damaged by natural disasters, including but not limited to winds equal to or in excess of strong gales, hurricanes, tornadoes as defined by Beaufort Scale, also wind launched debris, lightning, earthquakes or other similar acts of nature causes, or

b) The roofing system is damaged by acts of neglect, accidents, or misuse including, but limited to vandalism, civil disobedience, or acts of war, or

c) Metal work, drain inserts, fasteners, or other materials and equipment not supplied by OVR and causes leaks or other Roof damage.

5. This warranty shall be null and void in the event the judgement of OVR if any of the following occur:

a) If after installation of the roofing membrane system there are alterations or repairs made through the roof or attachments to the roof such as structures, fixtures, or utilities without first obtaining authorization from OVR, or

b) Failure to use reasonable care in maintaining the roof, or

c) There the terms and conditions stated herein are not complied with during life of the warranty.

6. During the life of this warranty, OVR employees, or other authorized persons shall have free access to the roofs during regular business hours.

7. OVR’s failure at any time to enforce any of the terms or conditions stated herein, shall not be construed to be a waiver of such provisions.

8. There are no warrantees that extend beyond the face hereof. Ottawa Valley Roofing shall not be liable for any incidental or consequential damages resulting from breach of warranty.
